This website is owned and operated by Fiberweb Geosynthetics Limited, a PGI business. Fiberweb Geosynthetics Limited is a company registered in England and Wales under company number 1589762, whose registered office is at Forsyth House, 211-217 Lower Richmond Road, London, TW9 4LN and whose primary place of business is at Blackwater Trading Estate, The Causeway, Maldon, Essex, CM9 4GG. Our registered VAT number is GB 888 1788 50. On this page we use the terms “we”, “our” and “us” to refer to Fiberweb Geosynthetics Limited, a PGI business.

These general terms and conditions of sale (“General Terms”) apply to any order you place through the Tubex website at www.tubex.com (the “Website”). Please read these terms and conditions carefully before ordering any products from our site. By placing an order through the Website, you confirm that you have read, understood and agree to these General Terms in their entirety. If you do not agree to these General Terms in their entirety, you must not order any product or service through the Website.

Website Terms and Conditions

Whenever you use this Website to order a Tubex product our Website Terms and Conditions will apply to your use of the Website as well as these General Terms. By ordering a Tubex product through the Website, you will be deemed to have read, understood and agreed to our Website Terms and Conditions. You can view our Website Terms and Conditions by clicking here.

Your Status

By placing an order through our site, you warrant that:

  • you are legally capable of entering into binding contracts; and
  • you are at least 18 years old.

Making a Purchase

To make a purchase simply browse through our product lists and choose the product you need from our catalogue. Click on the items that you wish to buy and put them in your shopping basket. After you have finished shopping, click on “Checkout” and you will be asked for a few details that we need to be able to satisfy the order. 

Please note that confirmation of the online checkout process does not constitute our acceptance of your order.

Our acceptance of your order will take place only when we dispatch the product(s) that you ordered from us and our acceptance will only relate to the product(s) dispatched and not any other products included in your order.  

Your right to cancel an order

At Fiberweb Geosynthetics Limited, we want you to be completely satisfied every time you shop with us. If for any reason you are unhappy with the product you have purchased just return it to us in its original condition within 30 days and we will issue a full refund for the price of the product. This does not affect your statutory rights. To make a return please wrap the package securely and send it to Customer Service Department, Fiberweb Geosynthetics Limited, Blackwater Trading Estate, The Causeway, Maldon, Essex, CM9 4GG. Before returning any products please contact our Customer Service Team on 01621 874200. You will be responsible for the cost of returning the item to us.

Price and Payment

The price of our products and our delivery charges will be as quoted on our Website from time to time, except in the case of obvious error. All prices are displayed in pounds Sterling exclusive of UK VAT where applicable unless expressly indicated otherwise.

Our Website contains a large number of products and it is always possible that, despite our best efforts, some of the products listed on our Website may be incorrectly priced. We will normally verify prices as part of our dispatch procedures so that, where a product’s correct price is less than our stated price, we will charge the lower amount when dispatching the product to you. If a product’s correct price is higher than the price stated on our Website, we will normally, at our discretion, either contact you for instructions before dispatching the product, or reject your order and notify you of such rejection. We are under no obligation to provide the product to you at the incorrect (lower) price, even after we have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as an error.

Please note that all products that you order through the Website will remain the property of Tubex until we have received payment in full from you for those products.

Delivery

Most orders are dispatched within 3 working days of receipt of your order. If we are unable to dispatch your order within 30 days we will contact you by email giving you the option to cancel your order. Orders will be delivered to the address stipulated by you on the order form.

We shall be under no liability for any delay or failure to deliver products if the delay or failure is wholly or partly caused by circumstances beyond our control.

All risk in the products you order (including risk of loss and/or damage to the products) shall pass to you when they are delivered to the delivery address specified in your order.

Delivery outside Mainland UK

If you order products from the Website for delivery outside Mainland UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.

Liability

There are certain liabilities which we cannot exclude by law and nothing in these General Terms limits our liability for personal injury or death caused by our negligence or for fraud. In addition, these General Terms shall not limit or exclude any other liability that we are not permitted to limit or exclude under applicable law.

Any products we supply to you will be of satisfactory quality and reasonably fit for purpose. If we deliver a product to you that is not of satisfactory quality or reasonably fit for purpose, you can contact us for a repair or replacement or, where this is not possible a refund. You must follow any advice we give you to keep the products we supply to you safe (including any instructions or product manuals provided with the products). We cannot accept liability for damage to products we have supplied which is caused by your failure to follow this advice.

We are only responsible for losses that are a natural, foreseeable consequence of our breach of these General Terms. We will not be liable to you if we are prevented or delayed from complying with our obligations under these General Terms by anything you (or anyone acting on your behalf) do or fail to do or due to events which are beyond our reasonable control.

In any event we will only be liable to you for the purchase price of the products. We will not be liable for any losses related to any business of yours including (without limitation) lost data, lost profits, lost revenues or business interruption.

Assignment

Severance
